First part of bill is reasonable, however, the statement - "When a vacancy occurs in any cooperative school board seat that is elected at large, any successor appointed to fill the vacancy shall be domiciled in the same municipality as the outgoing member was at the time of their election." This is too restrictive for At Large, when a vacancy occurs outside of voting cycle, there may not be an appropriate appointee within the same town as the outgoing at large member - this needs to be a little more flexible.

I appreciate the opportunity to provide a balanced perspective on HB 412, which addresses the methods for electing and appointing members to local cooperative school boards. Strengths of the Bill One of the notable strengths of HB 412 is its flexibility. The bill offers several alternatives for composing cooperative school boards, whether by electing members at large, dividing the district into single-member or multi-member districts, or other methods that support proportional representation. This flexibility allows each cooperative school district to tailor its board composition to best reflect the unique demographics and needs of its community. Additionally, the requirement that all elections use a non-partisan ballot system helps focus the process on qualifications and local issues rather than political affiliation. The provisions for filling vacancies—such as ensuring that an appointed successor is domiciled in the same municipality as the departing member—also work to maintain local accountability and continuity. Areas of Concern On the other hand, the bill’s flexibility could also lead to complexity and inconsistency across different districts. With multiple methods available for board composition, there is a risk of varied practices that might complicate statewide oversight. Moreover, the limitation of board member terms to three years, while enhancing accountability, could result in more frequent elections and place additional administrative and financial burdens on local governments. The requirement for successors to be domiciled in the same municipality might further restrict the candidate pool, especially in smaller communities, potentially making vacancy appointments more challenging. Finally, the multi-tiered process for filling vacancies may lead to delays or disputes if local officials are unable to reach agreement. Conclusion In summary, HB 412 presents a thoughtful approach to modernizing the selection and appointment process for cooperative school boards. It offers significant opportunities to enhance proportional representation and local accountability while also posing practical challenges related to complexity and administration. I encourage further study and open dialogue to ensure that the implementation of these provisions will be effective and fair for all communities. Thank you for your time and consideration.
